ESG ARENAS ONLINE BOOKING SYSTEM TERMS AND CONDITIONS – PAY TO PLAY

1. MAKING A BOOKING

   • These terms and conditions govern the online booking of stations in ESG Arenas Arenas operated by ESG ARENAS Retail Limited (a “Booking”). By making a Booking, you agree that your use of the online booking system, the Booking you make and your use of the station at the ESG Arenas Arena is governed by these terms and conditions.
   • If you are making a Booking, you must have a ESG ARENAS Account in order to complete your Booking. You must be 12 or older to make a Booking. If you are under 16, you confirm that you have your parent’s consent to make a Booking.
   • Before making a Booking, you must specify:
     • – which ESG Arenas Arena you wish to go to;
     • – the date on which you wish to make a Booking – Bookings cannot be made more than one month in advance;
     • – How many players are in your party. A maximum of 6 players can be included in a single Booking; and
     – How long you want the Booking to last (between 1 and 8 hours, in 1 hour increments).
   • Once you have provided this information, you will be shown which time slots are available for you to book, based on the information you have provided, and the price chargeable for each of the slots. The price varies depending on when you wish to make the Booking.
   • When you select which time slot you wish to book, you will have ten minutes within which to complete the Booking, including making payment, or you will lose the reservation and we reserve the right to make the slots you have selected available for another customer to book.
   • You will then be asked to confirm the contact details of the person making the Booking and the names and ages of the players who will be using the stations that are being booked (which need not be the same as the person making the Booking). Age details are required as we may restrict access to certain ESG Arenass based on the players’ ages, and/or may require parental consent for the players to be allowed to play certain age-restricted ESG Arenass. Players under the age of 12 must not be left in the ESG Arenas Arena without the supervision of a parent or guardian.

2. PAYING FOR A BOOKING
o We will take payment for your Booking in the following order:
 from any Arena Time stored on the ESG ARENAS Wallet associated with your ESG ARENAS Account;
 from any funds stored on the ESG ARENAS Wallet associated with your ESG ARENAS Account; and
 if you do not have any Arena Time or funds in your ESG ARENAS Wallet, or a balance remains payable once Arena Time or funds have been taken from your ESG ARENAS Wallet, you will be asked to pay the outstanding balance of the Booking fee using a credit or debit card.

3. CANCELLING A BOOKING
o Once you have booked a slot at a ESG Arenas Arena, you cannot choose to cancel that Booking and the fee paid is non-refundable, except as set out in 3.2 below.
o ESG ARENAS reserves the right to cancel any Booking at a ESG Arenas Arena for any reason and will try to give you as much notice as possible in the event that it needs to do so. Should ESG ARENAS cancel your Booking, we will give you a refund back via the same payment methods you used to pay for the Booking.

4. ARRIVING LATE OR LEAVING EARLY
o You must arrive at the ESG Arenas Arena within the first 15 minutes of your slot if you have booked a 1 hour or 2 hour slot, or within the first hour if your booking is for between 3 and 8 hours. If you arrive outside of this time period, we reserve the right to cancel your Booking and make the stations available to other users. You will not be entitled to a refund should this occur. If you arrive late, still wish to use the stations and the stations are still available, you will have to make another booking and pay the relevant fees for booking the stations.
o If you inform us that you wish to stop using the stations before your booked time is over, or if we have reasonable cause to believe that you have stopped using the stations and do not intend to return, we reserve the right to make the stations available for other users to book. Should this occur you will not be able to return to re-use the stations without paying an additional fee. You will not be entitled to a refund for any outstanding time left in your booking when you stop using the station(s).

5. OUR USE OF THE INFORMATION YOU GIVE US WHEN YOU BOOK
o The information you give to us when you make a Booking is used only for the purposes of making the Booking and making the stations at the ESG Arenas Arena available to you. We will not pass the information on to any third parties or use it for any other purpose within ESG ARENAS. ESG ARENAS complies with the provisions of the Data Protection Act 1998 at all times when handling customer data, and in accordance with our privacy policy.

6. CONDITIONS OF ENTRY TO THE ESG ARENAS ARENA
o You must have a ESG Arenas reward card to use the ESG Arenas Arena and confirm your reward card details are up to date before signing in to use the ESG Arenas Arena
o You must be signed into the ESG Arenas Arena by a member of the ESG ARENAS staff on the sign in sheet. The following details must be given and recorded Full name, Age, ESG Arenas reward card customer, Signature, Type of usage, Time of entry and date.
o Persons are allowed to leave the ESG Arenas Arena and return but must follow the sign out and sign in process and are required to keep their wristband and stamp to gain re-entry
o You will only be allowed to access age appropriate content in the ESG Arenas Arena (ESG ARENAS reserves the right to request proof of age which can only be one of the following. Driving Licence, UK passport or local authority proof of age card)
o On entering the Arena, you agree:
 You will wear your entry wristband at all times
 You will not play age restricted content that is inappropriate to your age
 You will not show age restricted content to other users which is inappropriate to their age
 You will not access any control settings on the Gaming Equipment without the express consent of Arena Management, including but not limited to technical settings, internet access and upload/download of data and files
 You will report any improper use or damage to ESG ARENAS property, whether deliberate or accidental, immediately to a ESG ARENAS member of staff
 To inform us of any medical conditions or allergies including light sensitive epilepsy

7. CHILDREN AND PARENTAL CONSENT
o You must be 12 years of age or above to enter the ESG Arenas Arena unaccompanied. ESG ARENAS will have a trained member of ESG ARENAS staff available at all times, but ESG ARENAS does not accept responsibility for anyone using the ESG Arenas Arena.
o Users under the age of 12 must be signed into the ESG Arenas Arena by an adult and must not be left unattended.

8. FOOD AND DRINK
o You are not permitted to bring food and drink into the ESG Arenas Arena unless agreed in advance with ESG ARENAS staff.
o ESG ARENAS do not provide hot food within the ESG Arenas Arena, but can assist in identifying food delivery options through ESG ARENAS’s selected partners. Food ordered with and delivered by such partners may be consumed within designated areas of the ESG Arenas Arena
o Cold snacks purchased from ESG ARENAS may be consumed in designated areas.
o Please ensure that any food debris which falls on the floor is picked/wiped up as soon as possible and report any spillages immediately to a member of ESG ARENAS staff

9. ESG ARENAS’S RIGHTS
o ESG ARENAS may refuse access and provide a full or pro-rata partial refund if you do not comply with these Terms of Use or where after reasonable warning your behaviour represents a danger to customers, staff or equipment – this refund represents the only compensation provided
o ESG ARENAS may restrict the availability of certain age related content where it is not practical to avoid exposure to other arena users or retail customers
o ESG Arenas reserves the right to require you to stop playing any content that you access from your own Steam, Xbox Live or PSN account within the ESG Arenas Arena if we believe it to be inappropriate to your age, but accepts no responsibility for the availability of such content
o The different types of usage of the ESG Arenas Arena are as follows: Publisher activity/Arena events; Esports events; Private Hire; Pay to play.
o ESG ARENAS reserves the right to withdraw or restrict the available types of usage within the ESG Arenas Arena at any time or close the ESG Arenas Arena without notice in its absolute discretion.
o ESG ARENAS reserves the rights to apply an admin charge for Esports events to cover staffing cost, equipment upkeep and utilities. This charge will be displayed at the time of event at the entry to the ESG Arenas Arena. A hand stamp is required for entry to such events.
o Persons who cause any damage to ESG ARENAS or third party property, ESG Arenas Arena elements and gaming equipment, whether deliberate or accidental, will be liable for the cost of repair or replacement of the items.
o ESG ARENAS reserves the right to eject any persons from the ESG Arenas Arena who: use explicit language; improperly use items and components in the ESG Arenas Arena; are aggressive or abusive in any way to other ESG Arenas Arena users or ESG ARENAS staff

10. MISCELLANEOUS
o ESG ARENAS gives no guarantee that the ESG Arenas Arena booking system will be available at all times.
o The ESG Arenas Arena booking system is provided for domestic and private use only. You agree not to use the booking system for any commercial or business purposes, and we have no liability to you for any loss of profit, loss of business, business interruption, or loss of business opportunity.
o We will not be liable for any loss or damage caused by a virus, distributed denial-of-service attack, or other technologically harmful material that may infect your computer equipment, computer programs, data or other proprietary material due to your use of the ESG Arenas Arena booking system, or ESG Arenas.gg.
o We assume no responsibility for the content of websites linked on the Site. Such links should not be interpreted as endorsement by us of those linked websites. We will not be liable for any loss or damage that may arise from your use of them.
o No one other than the person making the booking and ESG ARENAS has any rights under the Contracts (Rights of Third Parties) Act 1999 or any equivalent legislation in any jurisdiction, or otherwise, to enforce any term of these Terms and Conditions.
o ESG ARENAS does not exclude or limit in any way its liability to you where it would be unlawful to do so. This includes liability for death or personal injury caused by its negligence or the negligence of its employees, agents or subcontractors OR for fraud or fraudulent misrepresentation.
o These Terms and Conditions are subject to and shall be interpreted under English Law.
o ESG ARENAS reserves the right to amend these terms and conditions at any time by publishing the revised terms on our website. Any bookings made after the point at which the new terms and conditions are published will be bound by the revised terms and conditions.
ESG Arenas: Terms and Conditions for Online ESG Arenas Arena Hire Booking
1. Information about us and how to contact us
o We are ESG Arenas Retail Limited a company registered in England and Wales (“ESG ARENAS”). Our company registration number is 07837246 and our registered office is at Unity House, Telford Road, Basingstoke, Hampshire, RG21 6YJ. Our registered VAT number is 7837246.

2. Making an online ESG Arenas Arena hire booking
o These terms and conditions apply to online bookings for ESG Arenas Arena hire made via the booking system hosted on ESG Arenas.gg (a “Booking”), operated by ESG ARENAS Retail Limited. By making a Booking, you agree that your Booking, your use of the booking system via ESG Arenas.gg and your use of the ESG Arenas Arena in relation to your Booking, is governed by these terms and conditions.
o To make a Booking, you must have a ESG ARENAS Account in order to complete your Booking and be over the age of 18.
o To make a Booking, you must select:
 which ESG Arenas Arena you wish to go to;
 the date and time on which you wish to make a Booking – we may specify how far in advance we require you to make bookings, and restrict you from making bookings on shorter notice;
 which party package you require; and
 how many guests are in your Booking.
o Our charges for ESG Arenas Arena hire cover the items included in the package you select for your Booking, as set out on our ESG Arenas.gg website.
o When you select which time slot you wish to book, you will have twenty minutes within which to complete the Booking, including making payment, or you will lose the reservation and we reserve the right to make the slot you have selected available for another customer to book.
o You will then be asked to confirm the contact details of the person making the Booking and the age range and number of the players who will be using the stations that are being booked (which need not be the same as the person making the booking). Age details are required as we may restrict access to certain ESG Arenass based on players’ ages, and/or may require parental consent for players to be allowed to play certain age-restricted ESG Arenass.
o Your Booking includes exclusive access to 12 gaming stations. The maximum number of guests permitted for your Booking is 12.
3. Paying for your Booking
o The price of your Booking is dependant upon the party package you select, and is as specified on the booking system.
o The full price of your Booking is payable at the time you make your Booking.
o We will take payment for your Booking funds stored on the ESG ARENAS Wallet associated with your ESG ARENAS Account.
o Arena Time cannot be used as a method of payment for your Booking.
o Once you have completed, and paid for, your Booking, we will send you an email confirmation setting out the details of your Booking.
4. Cancelling a Booking
o We may cancel your Booking for reasonable cause. If we cancel your Booking, we will give you as much prior notice as we are able to, and will offer you a refund via ESG Arenas Wallet. Reasonable cause would include (but not be limited to) cancellation due to circumstances beyond our reasonable control, staff illness, technological issues, publisher activity.
o We are aware that your plans can change from time to time. Cancellations must be made in writing or by e-mail to the Arena you have booked. We will try where possible to help reschedule as needed but if you do cancel your Booking:
 4 weeks or more before the date of your Booking, then we will refund 100% of the price you have paid via ESG Arenas Wallet; or
 Within 4-2 weeks before the date of your Booking, then we will refund 50% of the price of your Booking via ESG Arenas Wallet; or
 Less than 2 weeks prior to the date of your Booking, then you will not be entitled to any refund, however you may rebook within the next 12 months, at your choice.
5. Conditions of entry
o Upon arrival at the ESG Arenas Arena, all guests must be signed in by a member of the ESG ARENAS staff. The following details must be given and recorded: Full name, Age, ESG Arenas reward card number (if applicable), time of entry and date.
o Persons are allowed to leave the ESG Arenas Arena and return but must follow the sign out and sign in process and are required to keep their wristband and stamp to gain re-entry
o Players under the age of 12 must not be left in the ESG Arenas Arena without the supervision of a parent or guardian.
o You will only be allowed to access age appropriate content in the ESG Arenas Arena (ESG ARENAS reserves the right to request proof of age which can only be one of the following. Driving Licence, UK passport or local authority proof of age card)
o On entering the Arena, you will ensure all members of your party group:
 will not play age restricted content that is inappropriate to their age
 will not show age restricted content to other users which is inappropriate to their age
 will not access any control settings on the Gaming Equipment without the express consent of Arena Management, including but not limited to technical settings, internet access and upload/download of data and files
 will report any improper use or damage to ESG ARENAS property, whether deliberate or accidental, immediately to a ESG ARENAS member of staff
 will inform us of any medical conditions or allergies including light sensitive epilepsy
o For children’s parties:
 2 adults must accompany the party group and supervise the members of your party group at all times, to ensure that if one is required to facilitate a toilet run, there is always another adult present with the party group. Please note that not all ESG Arenas Arenas have toilet facilities on site. ESG Arenas operate a DBS checking process on all ESG Arenas Arena staff, however our stores are public places, and as such, we cannot monitor other store visitors.
 In the absence of parental consent provided via the form provided with your Booking: (i) children under 12 will only be permitted to play ESG Arenass with a PEGI rating of 3 or 7; and (ii) children aged between 12 and 15 will only be permitted to play ESG Arenass with a PEGI rating of 12 and below.
o Please arrive on time for your Booking. If you arrive more than thirty minutes after the time of your Booking, we reserve the right to release the stations reserved for your Booking and no refund will be given.
6. Our use of the information you give us when you book
o The information you give to us when you make a Booking is used only for the purposes of making the booking and making the stations at the ESG Arenas Arena available to you. We will not pass the information on to any third parties or use it for any other purpose within ESG ARENAS unless you give your express consent for us to do so. ESG ARENAS complies with the provisions of the Data Protection Act 1998 (or such other legislation that amends, supersedes, updates or replaces it from time to time (including the General Data Protection Regulation (Regulation (EU) 2016/679)) at all times when handling customer data, and in accordance with our privacy policy.
7. Food and Drink
o You are not permitted to bring food and drink into the ESG Arenas Arena unless agreed in advance with ESG ARENAS staff.
o We do not provide hot food within the ESG Arenas Arena, but can assist in identifying food delivery options through ESG ARENAS’s selected partners. Food ordered with and delivered by such partners may be consumed within designated areas of the ESG Arenas Arena
o You may consume cold snacks purchased from ESG ARENAS in designated areas.
o Please ensure that any food debris which falls on the floor is picked/wiped up as soon as possible and report any spillages immediately to a member of ESG ARENAS staff

o We give no guarantee that the ESG Arenas Arena booking system will be available at all times.

If we fail to comply with these Terms, we are responsible for loss or damage you suffer that is a foreseeable result of our breaking this contract or our failing to use reasonable care and skill, but we are not responsible for any loss or damage that is not foreseeable. Loss or damage is foreseeable if either it is obvious that it will happen or if, at the time the contract was made, both we and you knew it might happen, for example, if you discussed it with us during the sales process.
o These Terms and Conditions are subject to and shall be interpreted under English Law.
o We reserve the right to amend these terms and conditions at any time by publishing the revised terms on our website. Any bookings made after the point at which the new terms and conditions are published will be bound by the revised terms and conditions.
